Pollution Liability
Pollution liability insurance sometimes referred to as Contractor pollution liability insurance (CPL) provides coverage for third-party injury, property damage, defense, and clean-up as a result of pollution conditions which arise on behalf of your contracting operations.
This type of policy protects contractors and businesses against liability from damage caused by hazardous waste materials or “pollutants” should a claim arise. Coverage includes protection on bodily injury claims and property damage, along with clean-up costs caused by contamination from toxic waste materials.
A pollutant is defined as: any substance, as certain chemicals or waste products, that renders the air, soil, water, or other natural resource harmful or unsuitable for a specific purpose.
Examples of pollutants:
- smoke
- vapor
- soot
- fumes (paint or welding fumes)
- Mold
- Asbestos
- Bacteria
- acids
- alkalis
- chemicals
- waste
Contractors who may need pollution liability:
- Water restoration companies (abatement and remediation)
- Drywall contractors
- General contractors
- Plumbers
- Demolition
- Electrical
- Grading, site, and excavation
- Roofers
- Industrial and pipeline contractors
- Sewer, waste and utility contractors
Businesses that produce hazardous waste emissions during manufacturing—including oil, agribusiness, construction, excavation, waste depositories, and asbestos abatement contractors benefit from pollution liability coverage.
A contractor-based policy may be offered on a claims-made or occurrence basis, that provides third-party coverage for bodily injury, property damage, defense, cleanup, and related defense costs as a result of pollution conditions (sudden/accidental or gradual) arising from contracting operations performed by or on behalf of the contractor.
